The Office of the Internet Information Office recently issued the Interim Provisions on the Development and Management of Public Information Services for Instant Messaging Tools. The full text of the Regulations is as follows:

Article 1 To further promote the healthy and orderly development of public information services for instant messaging tools, protect the legitimate rights and interests of citizens, legal persons and other organizations, and safeguard national security and public interests, according to the "National People's Congress Standing Committee's Decision on Maintaining Internet Security" , "Decision of the Standing Committee of the National People's Congress on Strengthening the Protection of Network Information", "Interpretation of the Supreme People's Court Supreme People's Procuratorate on Several Issues Concerning the Application of Laws in the Handling of Information Systems and Criminal Cases", "Administrative Measures on Internet Information Services", These regulations are formulated in laws and regulations such as the "Internet News Information Service Management Regulations".

Article 2 These Provisions apply to the public information service of instant communication tools within the territory of the People's Republic of China.

The instant messaging tool referred to in these Provisions refers to an application based on the Internet to provide instant information exchange services to end users. The term "public information service" as used in these Regulations refers to the activity of releasing information to the public through public accounts and other forms of instant communication tools.

Article 3 The National Internet Information Office is responsible for coordinating and guiding the development and management of public information services for instant communication tools. The provincial Internet content management department is responsible for the relevant work in this administrative region.

Internet industry organizations should play an active role in strengthening industry self-discipline, promoting the construction of industry credit evaluation systems, and promoting the healthy and orderly development of the industry.

Article 4 The instant messaging service provider shall obtain the relevant qualifications as stipulated by laws and regulations. Instant messaging service providers engaged in public information service activities should obtain Internet news information service qualifications.

Article 5 Instant communication tool service providers shall implement safety management responsibilities, establish and improve various systems, equip professionals who are appropriate to the scale of services, protect user information and citizens' personal privacy, consciously accept social supervision, and promptly handle public reporting violations. Article 6 The instant messaging tool service provider shall, in accordance with the principle of “real-name background and front-end voluntary”, require the instant messaging tool service user to register the account after authenticating the identity information.

When instant messaging service users register their accounts, they should sign an agreement with the instant messaging service provider to commit to comply with the laws and regulations, the socialist system, the national interests, the legitimate rights and interests of citizens, public order, social morality and information authenticity. Article 7 Users of instant messaging service services who open public accounts for public information service activities shall be reviewed by the instant messaging service provider and classified by the instant messaging service provider to the Internet information content authority.

The public accounts opened by news organizations and news websites can be published and reprinted, and the public accounts opened by non-news units that have obtained the qualifications of Internet news information services can be reprinted with political news. Other public accounts may not publish or reprint political news without approval.

Instant messaging service providers should mark public accounts that can post or reprint current news.

Party and government organs, enterprises and institutions and various people's organizations at all levels are encouraged to open public accounts to serve economic and social development and meet the needs of the public.

Article 8 Users of instant messaging tools serving in public information service activities shall abide by relevant laws and regulations.

For instant messaging service users who violate the agreement, the instant messaging service provider shall take measures such as warning, restriction, suspension, and closure until the account is closed, and save the relevant records and fulfill the obligation to report to the relevant competent authority.

Article 9 Any violation of these Provisions shall be handled by the relevant department in accordance with relevant laws and regulations.

Article 10 These Provisions shall come into force as of the date of promulgation.
